By ordering from our site you signify your agreement to the following terms and conditions. We reserve the right to change these terms and conditions from time to time so please check the current terms and conditions before placing any order.
1. BUYER’S RESPONSIBILITY
The buyer is responsible for monitoring their own health and acting responsibly in wearing the Smileybelt. In the highly unlikely event that it increases pain and/or dysfunction, you should not wear the belt. Smileybelt Group Limited takes no responsibility for any adverse outcomes from wearing a Smileybelt.
2. PAYMENT
Payment is required by cheque, direct bank deposit, credit card via Pay Pal or Afterpay for purchases made in New Zealand, or by Credit Card via Pay Pal or Afterpay for international purchases. Details are emailed to you after your order is received.
3. DEFECTS AND DAMAGE
You should inspect the goods on delivery and shall within 10 days of delivery notify us of any alleged defect, or damage. If you fail to comply with these provisions the goods shall be conclusively presumed to be free from any defect or damage which would be apparent on a reasonable examination of the goods and you will be deemed to have accepted the goods. If required by Smileybelt Group Limited you will return any damaged goods before a replacement is dispatched.
4. LIABILITY
The liability of Smileybelt Group Limited shall be limited to the value of any damaged or defective goods supplied. Smileybelt Group Limited shall be under no liability whatever to the buyer for any direct or indirect loss and/or expense (including loss of profit) suffered by the buyer arising from use of the product or by any breach by Smileybelt Group Limited of this agreement.
5. RESTRICTIONS AND USE OF MATERIALS
No material on this site or purchased from this site may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way. All copyright and intellectual property rights in the website and in the goods sold by Smileybelt Group Limited shall remain the property of Smileybelt Group Limited.
6. GOVERNING LAW AND JURISDICTION
New Zealand law will govern any dispute between the parties about this agreement’s formation or construction, or the rights or liabilities of the parties to it.
7. DELIVERY POLICY
All goods are dispatched by Post.
